  • In a written judgment of the High Court of Malaya at Kuala Lumpur (Construction Court 1), Writ WA-22C-10-01/2022, Nadzarin Wok Nordin J found that a purchased unit at the Agile Mont Kiara project had numerous defects including dampness, water leaks, water ingress, a failed waterproofing system, wall cracks, flooring issues and incomplete finishing that had not been properly remedied, rendering the parcel uninhabitable, and held that the developer Agile PJD Development Sdn Bhd had failed in its implied obligation to construct the parcel to a standard befitting a luxury condominium.

  • At Residensi Duta Kiara (formerly Agile Mont Kiara), where keys were handed over in 2020 and the defect liability period ended in July 2023, the developer has returned to carry out further works including in the car park area and additional layering to the basketball court surface; the criticism of standards is directed at a previous management company rather than the developer.

  • In the same judgment the court concluded that Agile PJD Development Sdn Bhd had negligently failed to carry out defect rectification works properly and diligently, found delays in addressing defects that were without valid justification and that aggravated the damage, awarded RM189,538.15 special damages, RM200,000 general damages and RM100,000 exemplary damages (the court describing the defendant's conduct as lackadaisical), and ordered the developer to issue within 14 days a letter of guarantee and indemnity to rectify the defects within not more than six months.
